The State's Duty Cannot Be Delegated Away
When a county or city takes a child into foster care, it takes on the duty of a parent. That duty does not disappear when the county or city writes a check to a non-profit to place the child: the city or county cannot delegate supervision to a contractor and then walk away when that child is sexually abused.
New legislation, A4362-B / S9778-A, makes that principle the law — clearly, consistently, and without exception.
